- Provide accurate and complete registration information
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our services under applicable law

6. Subscription Plans and Payments

Billing:
- Subscriptions are billed monthly or annually in advance
- Payments are processed securely via Stripe
- All prices are displayed in USD and may be subject to local taxes
Cancellation:

- Cancellation takes effect at the end of the current billing period
- No refunds are issued for partial billing periods
7. Acceptable Use
By using Mama Studio, you agree not to:
- Upload photos of individuals without their explicit consent
- Generate portraits of minors without verified parental consent
- Use our platform to create misleading, fraudulent, or defamatory content
- Attempt to reverse-engineer, copy, or replicate our AI technology
- Use automated tools, bots, or scrapers to access our platform
- Upload content that is illegal, obscene, hateful, or violates third-party rights
- Resell or sublicense AI-generated portraits under a Free or Standard plan
- Circumvent any security measures or access restrictions on our platform
Violation of these rules may result in immediate account suspension and legal action where applicable.
8. Intellectual Property
Mama Studio Content: All technology, design, branding, and platform content is the exclusive property of Mama Studio and protected by applicable intellectual property laws. Unauthorized reproduction or use is strictly prohibited.
User-Uploaded Photos: You retain full ownership of any photos you upload. By uploading, you grant Mama Studio a limited, non-exclusive license to process your images solely for portrait generation purposes.
AI-Generated Portraits: Upon generation, portraits are licensed to you for personal or commercial use depending on your subscription plan. Full ownership terms are detailed in our Copyright Policy.
9. Privacy and Data Protection
Your use of Mama Studio is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our platform, you consent to the collection and processing of your personal data as described in our Privacy Policy available at mamastudio.com/privacy.
10. Disclaimers and Limitation of Liability
Service Availability: Mama Studio is provided on an « as is » and « as available » basis. We do not guarantee uninterrupted or error-free service and reserve the right to perform maintenance at any time.
AI Accuracy: AI-generated portraits are created algorithmically and may not perfectly replicate photographic accuracy. Mama Studio makes no warranty regarding the exact likeness or quality of generated portraits.
Limitation of Liability: To the fullest extent permitted by law, Mama Studio shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of data or generated portraits due to technical failure
- Unauthorized access to your account resulting from your failure to secure your credentials
- Any damages exceeding the total amount paid by you to Mama Studio in the 3 months preceding the claim
11. Indemnification
You agree to indemnify and hold harmless Mama Studio, its officers, employees, and partners from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your uploaded content infringing third-party rights
- Your misuse of AI-generated portraits
- Any false or inaccurate information provided during registration
12. Termination
Mama Studio reserves the right to suspend or permanently terminate your account at any time, with or without notice, if:
- You violate any provision of these Terms
- Your account is used for fraudulent or illegal activities
- We are required to do so by applicable law
Upon termination, your right to access Mama Studio ceases immediately. Generated portraits stored in your account may be deleted after 30 days following termination.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of France. Any dispute arising from your use of Mama Studio shall first be subject to good faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Paris, France.
EU users retain the right to access the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Changes to These Terms
Mama Studio reserves the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on our website at least 14 days before they take effect. Continued use of our platform after that date constitutes acceptance of the updated Terms.
